Merit Systems Protection Board

California MSPB Lawyer

Federal employees have rights and one of those rights is to be judged on the quality of their work, rather than whether or not they enjoy the political support of a particular Administration. Protecting this right is the purpose of the Merit Systems Protection Board (MSPB). And our California MSPB lawyer has extensive and wide-ranging experience that federal employees can draw on to ensure their rights get protected.

Attorney Ron Ackerman has over 30 years of experience to draw on in protecting employee rights. In addition to his extensive legal background, he’s spent time in both federal law enforcement and doing union work. All of that meshes together to give him unique insights into the specific challenges of federal employees.

Based in California, the Law Office of Ronald P. Ackerman serve clients nationwide. Call today at (310) 878-4442 or reach out here online.

The Purpose of the Merit Systems Protection Board

The MSPB was created as a result of the Civil Service Reform Act of 1978, which aimed to modernize and improve the federal civil service system. Prior to the creation of the MSPB, there were no independent agencies responsible for protecting federal employees from wrongful termination, discrimination, or retaliation. Instead, these issues were handled by various agencies within the executive branch, which often led to conflicts of interest and inconsistent enforcement.

The MSPB was designed to be an independent agency, with three members appointed by the President and confirmed by the Senate for staggered seven-year terms. The Board's primary function is to adjudicate appeals filed by federal employees who have been subjected to adverse personnel actions such as removals, suspensions, denials of promotion, or reductions in pay.

Over the years, the MSPB has played a critical role in protecting the rights of federal employees and promoting fairness and transparency in government employment practices. However, it has also faced criticism for being slow and bureaucratic in its decision-making process. A California MSPB attorney, who understands the system and how to make things move, may prove valuable to an employee with a grievance.

How Our California MSPB Lawyer Can Help

While legal counsel is not strictly necessary to appeal an agency action, the hard reality is that navigating the MSPB appeals process can be complex and overwhelming. An experienced lawyer can guide you through the process, help you understand your rights, and advocate on your behalf.

A prime example of where reliable counsel can help is in the preparation of the case. This includes gathering evidence, interviewing witnesses, and developing legal arguments that support the employee’s stance, the same as an attorney can do in other fields of law. And when it comes to dealing with the MSPB in particular, an employee dealing with a stressful situation may well appreciate our ability to handle filing the appropriate paperwork to get the appeals process started, and then meet deadlines along the way.
